Staff Partner Agreement

INDEPENDENT SERVICE PROVIDER AGREEMENT (FOR STAFF/PARTNERS)

1. Nature of Engagement (Independent Contractor Status)

  • No Employer-Employee Relationship: The Service Provider (Staff) registers on Workeezi as an autonomous, freelance, independent contractor. Registration does not constitute an employment contract, salary guarantee, or employee benefits from Workeezi. Payouts are strictly “Work-Done-Basis” calculated daily and disbursed weekly after platform commission deductions.

2. Mandatory Registration & Background Verification (BGV) Policy

  • Mandatory Verification: To activate a profile on workeezi.in, the Staff must undergo absolute credential and identity filtering.
    • BGV Options & Fees Borne by Staff: * Option A: Staff must upload a recently issued, verified Police Clearance Certificate (PCC) on their own accord.
    • Option B: Staff can opt for Background Verification (BGV) through Workeezi’s designated third-party verification partners. The standard BGV fee charged by the verification vendor must be entirely borne by the Staff and will be deducted from their initial onboarding setup or paid upfront.
  • Fraudulent Documentation: If any degree, Aadhar card, registration license, or BGV document is found to be forged or tampered with at any stage, the profile will be blacklisted instantly, all accumulated wallet earnings will be permanently frozen, and criminal proceedings for cheating and forgery will be initiated.

3. Service Delivery Guarantee & Daily Attendance Logs

  • Duty of Care: Once a Staff member clicks “Accept” on an On-Demand booking request, they are legally bound to ensure professional service delivery as per the designated Job Description (JD). Unannounced absents or leaving a critical patient unattended without a 24-hour prior notice to the admin will attract standard performance penalties.
  • Daily In/Out and OTP Mapping: Payout generation is strictly tied to digital compliance. The staff must mark their “In & Out” daily on the web portal and input the Customer-Generated Completion OTP at the end of each shift. Failure to lock the daily OTP means the transaction engine will not credit that shift’s earning to the staff ledger.

4. Zero Tolerance for Direct Dealings (Breach of Contract)

  • Bypassing the Platform: If any Staff member is found sharing personal phone numbers to bypass Workeezi, accepting cash directly from the customer without administrative logging, or continuing services privately even after marking the order “Completed” on the dashboard, it will be treated as a material breach of contract.
  • Deactivation and Damages: The Staff profile will be permanently deactivated/banned with zero access to the platform in the future, all current wallet balances/payouts will be forfeited as liquidated damages, and Workeezi reserves the right to recover financial losses via legal notice.

MISCELLANEOUS CLAUSES (GOVERNING JURISDICTION)

1. Governing Law & Dispute Resolution

  • This agreement, the digital marketplace ecosystem of www.workeezi.in, and all bilateral issues between Customers, Staff, and the Platform shall be governed exclusively by the federal laws of India.

2. Absolute Jurisdiction (Delhi Court Lock)

  • In the event of any legal dispute, consumer court complaints, arbitration, or litigation arising out of medical disclaimers, breach of contract, safety issues, or financial transactions, the courts of New Delhi, India alone shall have exclusive jurisdiction to try and resolve the matter.
