TERMS OF SERVICE & CONDITIONS (FOR CUSTOMERS/PATIENTS)

1. Scope of Platform & Aggregator Status (Section 79 IT Act Protection)

  • Intermediary Platform: www.workeezi.in (hereinafter referred to as “Workeezi”, “Platform”, or “Company”) is an online digital aggregator marketplace operated under the legal framework of an Intermediary. Workeezi does not directly provide, employ, or manage any healthcare, nursing, physiotherapy, or caregiving services.
  • No Medical Liability: The contract for actual service delivery is strictly a bilateral agreement between the Customer and the registered independent Service Provider (Staff). Workeezi is NOT liable for any medical consequences, clinical malpractice, misdiagnosis, negligence, or health deterioration resulting from the services rendered by the Staff.
  • Implied Medical Consent: By finalizing a booking, selecting a staff member, or allowing the staff to initiate the service session, the Customer gives their explicit, unconditional clinical consent for the designated procedures.

2. Staff Safety & Strictly Professional Scope of Work

  • No Household/Menial Labor: Staff registered on Workeezi are certified professionals (Nurses, Physiotherapists, Caregivers). The Customer is strictly prohibited from demanding any household chores, cleaning, cooking, or any tasks outside the specific Job Description (JD) displayed on the staff’s profile or service page.
  • Safe Working Environment: The Customer is legally obligated to ensure a safe, respectful, and hazard-free environment for the Staff. Any form of verbal abuse, physical threat, sexual harassment, or unhygienic working conditions will result in immediate termination of service without refund, and the platform will fully support the staff in filing criminal complaints under the Bharatiya Nyaya Sanhita (BNS).

3. Advance Wallet Funding, Non-Payment, & Service Termination

  • Escrow/Wallet Guarantee: The Customer must maintain a minimum balance equivalent to the estimated cost of scheduled shifts/sessions in their Workeezi Wallet.
  • Right to Terminate for Non-Payment: Payment deduction occurs dynamically on a per-shift/per-session completion basis via the OTP system. If the wallet balance drops below the threshold required for the next consecutive shift, Workeezi reserves the absolute right to automatically suspend or permanently terminate the service session immediately. Workeezi and its staff shall bear zero liability for any medical or health-related consequences arising out of such payment-default suspensions.

4. Anti-Circumvention & Strict Anti-Poaching Clause (Direct Dealings Penalty)

  • Ban on Direct Solicitation: The Customer is strictly forbidden from entering into a direct financial or professional arrangement with any Staff introduced through Workeezi, bypassing the platform.
  • Legal and Financial Penalty: If a Customer is found to be engaging, paying, or hiring the Staff directly outside the Workeezi ecosystem during the service period or within 12 months after its completion, the Customer shall be liable to pay a contractual breach penalty of ₹1,00,000 (INR One Lakh) or the total projected billing of 6 months (whichever is higher), along with immediate permanent deactivation of their Workeezi account and potential civil litigation.

MISCELLANEOUS CLAUSES (GOVERNING JURISDICTION)

1. Governing Law & Dispute Resolution

  • This agreement, the digital marketplace ecosystem of www.workeezi.in, and all bilateral issues between Customers, Staff, and the Platform shall be governed exclusively by the federal laws of India.

2. Absolute Jurisdiction (Delhi Court Lock)

  • In the event of any legal dispute, consumer court complaints, arbitration, or litigation arising out of medical disclaimers, breach of contract, safety issues, or financial transactions, the courts of New Delhi, India alone shall have exclusive jurisdiction to try and resolve the matter.
